Section 1 Definitions used in the "Terms and Conditions"

Section 3. Application of the "Terms and Conditions"

  • All services, including site services, provided by the Company and its respective affiliates, related companies, unaffiliated partners and/or licensors are provided to visitors subject to our "terms and conditions"
  • By visiting, using or accessing (in person, by computer, by e-reader, mobile device or other electronic device) the Skyshop website - mobile adapted website, mobile application or any product, content or other services available on Skyshop - visitors agree to be bound by these terms and conditions and other additional or alternative rules and policies that are displayed or to which visitors may be directed through any particular Skyshop page. Without limiting the generality of the foregoing, the "Terms and Conditions" also apply if a visitor accesses a Skyshop service or website, or authenticates as a user, through a third-party website or social media application (for example, through Twitter®, Facebook®, or other means). These "Terms and Conditions" cannot be modified once they have been accepted by the visitor/customer (including negotiations or sales via email, telephone and other means of communication). If the visitor does not agree to these "Terms and Conditions", the visitor/customer should not access Skyshop's services or website.
  • Certain trade marks or trade names, service marks and logos used or displayed on the Skyshop website are registered and unregistered. Under no circumstances do the trade marks and logos displayed on the Skyshop website have any direct connection or other relationship with Skyshop. There are various registered and unregistered brands and affiliates on the Skyshop website for which we only sell their products without any liability whatsoever, both on the website and in the physical shop.
  • It is the customer's responsibility to check and obey all applicable local, state/regional, federal and international laws (including minimum age requirements) regarding the possession, use and sale of any item purchased on the Skyshop website. By purchasing or placing an order, the customer declares that the products purchased will be used only in a lawful manner. All DVDs/games or any multimedia or similar items and products sold are for private home use (where no admission charge is made), hidden/confidential performance may not be duplicated or displayed in public places for commercial purposes.
  • Choice of Law - Jurisdiction: The "Terms and Conditions", the use of the Skyshop website and all related matters are governed exclusively by the laws of Portugal, excluding any rules of private international law or conflict of laws that would lead to the application of other laws. To the extent permitted by law, any claim or cause of action that customers may have arising out of, relating to, or in connection with the use of the Skyshop website, or these "Terms and Conditions", customers agree that any dispute resolution process will only be undertaken on an individual basis and not in a single section or consolidated or representative action.

Section 4 Offers: Products and Services

  • Products and services offered are registered in the Skyshop database.
  • The Skyshop website is internally blocked by the Skyshop database.
  • Products offered are presented and installed at Skyshop in Lisbon, Portugal, unless otherwise stated on the Skyshop website.

    Section 4a Resignation

  • Prices: Products and services may inadvertently be priced incorrectly.
  • Any unintentional error. Skyshop shall not be obliged to supply goods or services at an incorrect price.
  • Discrepancies in quantities between the Skyshop website and the actual situation are not binding on Skyshop.
  • Obvious errors or mistakes in the description or representation of the products offered are not binding on Skyshop.

    Section 4b. Prices

  • Products in Skyshop and on the Skyshop website are offered at prices expressed in euros including applicable VAT.
  • There may have been price discrepancies as a result of daily exchange operations.
  • In the event of price discrepancies or errors in Skyshop products, the prices of these products published on the Skyshop website shall prevail.
  • Skyshop is not obliged to provide prices that differ from those published on the Skyshop website.
  • Products and services may inadvertently be incorrectly priced. Any error is unintentional. Skyshop will not be obliged to supply goods or services at the incorrect price.

Section 5 Tax

  • All sales and deliveries within the European Union are subject to Portuguese VAT: 6% VAT for books and magazines and 23% VAT for all goods/products and services.
  • Skyshop offers products and services, including VAT, regardless of the customer's nationality or country of origin or destination.
  • Customers located in or with a delivery address in countries outside the European Union are responsible for the appropriate import documentation and licences and for paying the applicable import duties, taxes and handling.

Section 6 Skyshop in Lisbon

    Section 6a. Exchange of purchased products

Exchanges of products purchased from Skyshop will be accepted under the following conditions:

  • The exchange is made at Skyshop.
  • The exchange must be made within 7 days from the day of purchase or after consulting Skyshop at a later date.
  • In order for an exchange to be possible, any item purchased on the Skyshop website must be photographed and sent to Skyshop for visualisation.
  • The items to be exchanged must have their packaging intact and undamaged and must be in their proper saleable condition.
  • Products exempt from exchange:
    - Non-prefabricated products made on the basis of an individual choice or decision by the customer or which are clearly customised to the customer's specifications;
    - Goods of a personal nature, such as: underwear (socks, boxers); earrings; shoes (not worn);
    - Goods with limited shelf life;
    - Video recording or computer software that has not been sealed after delivery;
    - Temporary products, such as magazines;
    - Multimedia products (from the moment the packaging is opened).
    - Special requests;

    Section 6b. Warranty and Claims

  • Products purchased from Skyshop are free from defects unless otherwise stated or can be assumed to be so.
  • Complaints must be reported to Skyshop immediately and within 48 hours of receiving the product.
  • When items are purchased in person at Skyshop's premises, customers must check the items and the contents of the packages before leaving Skyshop's premises.
  • Skyshop is not responsible for any costs incurred by customers travelling to retrieve products (in this case it will have to be negotiated by both parties).
  • The legal guarantee for products that are covered by a guarantee, such as watches, electronic calculators or other items bought by citizens of the European Union is 2 years after purchase.
  • Warranty claims after 2 years will only be processed in accordance with the warranty and conditions applied by the manufacturer.
  • The guarantee for goods purchased by non-EU citizens is in accordance with the applicable guarantees of their respective manufacturers, distributors and suppliers, if any.
  • After 2 years the guarantee expires when it can no longer be entrusted to the respective manufacturer, distributor or suppliers affected by bankruptcy or cessation of production.
  • Eligible warranty claims at Skyshop or its suppliers imply free repair or replacement. Skyshop is not responsible for and does not bear any costs or customs duties arising from items covered by warranty. Skyshop cannot be held liable for any item that has been modified, altered in whole or in part by the factory, distributor or supplier. Skyshop is not liable for consequential damages or inconvenience.

Section 7 Skyshop

    Section 7a General

  • Products, Contents and Specifications: All features, contents, specifications, products, prices and services described on the Skyshop website are subject to change at any time without notice. Certain measurements and similar descriptions are provided for convenience purposes only. The display and colour capabilities of the equipment used to display may affect the colours actually experienced on the screen. There is no guarantee of colour, texture or detail of products to accurately correct the product listed. Product descriptions will be given with the utmost accuracy. Descriptions may be incomplete or out of date.
  • Availability: All items displayed on the Skyshop website do not necessarily have to be available, and for some reason the product displayed may not be in stock. If you pay for an out-of-stock item, Skyshop will refund your money or you can exchange it for another item. Skyshop is not liable for any damages resulting from this action (items not in stock).
  • Typing errors: Information on the Skyshop website may contain typographical errors, inaccuracies or omissions relating to product descriptions, prices, promotions, offers and availability.
  • CorrectionsSkyshop reserves the right to correct, at any time and without prior notice, errors, inaccuracies or omissions and to change or update information or cancel orders if any information on the site is inaccurate (including after ordering online).
  • Information accuracy: Skyshop endeavours to ensure that the information on the Skyshop website is complete, accurate and up-to-date. Despite Skyshop's efforts, the information on the Skyshop website may occasionally be inaccurate, incomplete or out of date. Skyshop makes no representation as to the completeness, accuracy or timeliness of any information on the Skyshop website. For example, products included on the Skyshop site may not be available, may have different attributes than those listed, or may actually have a different price than that indicated on the Skyshop site. In addition, Skyshop may make changes to price and availability information without prior notice. Skyshop always confirms by email or other means all orders placed on the website, however any order with payment does not guarantee the momentary or permanent purchase of the product. Skyshop reserves the right, without prior notice, to limit the order quantity on any product or service and/or refuse service to any customer. Skyshop may also require verification of information prior to acceptance and/or dispatch of any order.
  • Using the Skyshop website: The design of the Skyshop website and all text, graphics, information, content and other materials displayed that can be downloaded from the Skyshop website are protected by copyright, trademark and other laws and may not be used except as permitted in the "Terms and Conditions" or with the prior written authorisation of the owner of such material. Visitors to the Skyshop website may not modify the information or materials displayed on or downloadable from the Skyshop website or reproduce or display, perform or distribute or use any information or materials for any public or commercial purpose. Any unauthorised use of such information or materials may violate copyright laws, trademark laws, the laws of privacy and publicity and other laws and regulations.
  • Link to the Skyshop website: Creating or maintaining any link from another website to any page on the Skyshop website without Skyshop's prior written permission is prohibited. Running or displaying the Skyshop Website or any information or material displayed on the Skyshop Website in frames or by similar means on another website without the prior written permission of Skyshop is prohibited. All permitted links to the Skyshop website must comply with all applicable laws, rules and regulations.
  • Third-party links: From time to time, the Skyshop website may contain links to websites that are not owned, operated or controlled by Skyshop. All such links are provided solely as a convenience to the visitor. If visitors use these links, they will leave the Skyshop website. Neither Skyshop nor any of Skyshop's respective affiliates are responsible for any content, materials or other information located on or accessible from any other website. Neither Skyshop nor any of Skyshop's respective affiliates endorse, guarantee, or make any representations or warranties regarding other sites, or any content, materials or other information located on or accessible from any other site or the results visitors may obtain from using any other site. Visitors who decide to access any other sites linked to or from the Skyshop website do so entirely at their own risk.
  • Waivers: Use of the Skyshop website is at the visitor's own risk. The information, materials and services provided through the Skyshop website are provided "as is" without any warranties of any kind, including warranties of merchantability, fitness for a particular purpose or non-infringement of intellectual property. Neither Skyshop nor any of its affiliates warrant the accuracy or completeness of the information, materials or services provided on or through the Skyshop website. The information, materials and services provided through the Skyshop website may be out of date and neither Skyshop nor its affiliates make any commitment or assume any duty to update such information, materials or services. All products and services purchased through or on the Skyshop website are subject only to the applicable warranties of the respective manufacturers, distributors and suppliers, if any. To the fullest extent permitted by applicable law, Skyshop disclaims all warranties of any kind, express or implied, including any implied warranties with respect to the products and services listed on or purchased through the Skyshop website. Without limiting the generality of the foregoing, Skyshop expressly disclaims all liability for product defect or failure, claims due to normal wear and tear, product misuse, abuse, product modification, improper product selection, failure to conform to any code or misappropriation.
  • Limitation of liability: the Skyshop website assumes no responsibility, or shall be liable, for any damages to, or viruses that may infect, a visitor's computer, telecommunications equipment or other property caused by or arising out of a visitor's access to, use of, or browsing in the Skyshop website, or a visitor's downloading of any information or material from the Skyshop website. In no event shall Skyshop, nor any party involved in creating, producing or transmitting the Skyshop site, be liable to visitors or any other person for any indirect, special, punitive, incidental or consequential damages (including, without limitation, those resulting from lost profits, lost data or business interruption, lost data or business interruption) arising out of the use, inability to use or results of the use of the Skyshop website, any websites linked to the Skyshop website, or the materials, information or services contained on any such website, whether based on warranty, contract or any other legal theory and whether or not advised of the possibility of such damages. In the event of any problems detected with the Skyshop website or any content, visitors agree that the sole remedy is to leave the Skyshop website.

    Section 7b. Online shopping contract

Conditions for completing the online shopping contract (Order):

  • Order placed by customer
    1. Confirmation by the customer of products or services ordered via the Skyshop website.
    2. Customer acceptance of Skyshop's Terms and Conditions.
    3. Full payment by the customer of the total amount due in respect of the order.
  • Skyshop acceptance
    1. Confirmation by Skyshop that the order has been received.
    2. Confirmation from Skyshop that payment has been received.
  • Orders without full payment of the total amount due are not accepted and will not be processed.
  • Skyshop reserves the right to refuse orders or contracts without justification.
  • Any order placed at Skyshop will only be dispatched when all the processes have been completed (provision of shipping details, full payment).
  • Shipping costs will always depend on the size and weight of each item and region (see table).

 

    Section 7c. Order process

  • Orders are processed during Skyshop's business hours.
  • Skyshop stocks more than 60,000 aviation entertainment products at any one time.
  • Items will be dispatched once payment has been confirmed.
  • Provided all the products ordered are available: orders are dispatched within two working days.
  • Orders for products not yet available (pre-orders, future realeases, future releases, undated releases, etc.) will only be booked with full payment for the item in question.
  • Skyshop always endeavours to dispatch products with the utmost urgency for the best customer satisfaction, however it is not responsible for delays resulting from carriers and other logistics partners. Whenever there is a delay on the part of our partners in dispatching an item, Skyshop will make every effort to ascertain the reason for the delay and the location of the parcel. Under no circumstances will Skyshop compensate any customer in the event of delays.
  • Losses: in the event of a package being lost, Skyshop will take out insurance for the item and process a refund equal to the amount paid by the customer. We are not responsible for having to buy the same product in the case of a rare item.

    Section 7d. Pre-orders

Many product launches are announced on the Skyshop website. In special cases, these can be booked in advance. In this case, it is mentioned as such on the product details page. If it is not mentioned, then it is not available for pre-order. Delivery times are not available because they depend on many variables beyond Skyshop's control. Often, producers or distributors announce the production of products many months before the actual launch.


The following applies to pre-orders:

  • Pre-orders for different products are considered and treated as separate orders.
  • If for any reason one of the items ordered and paid for is cancelled by the manufacturer, Skyshop will refund the full payment.
  • Skyshop does not refund prepaid items in the event of a prolonged delay on the part of the manufacturer.
  • As a rule, manufacturers have a lot of delays and Skyshop cannot be held responsible for any inconvenience caused by these delays.
  • Skyshop is also not responsible for any delays on the part of manufacturers.
  • In the event of a pre-order (reservation, item not available), postage will always be charged unless you select other available means (Hold & Store, Pick-up).
  • In the event that the customer wishes to purchase an item that is available and another that is not yet available, they must inform Skyshop if they wish to combine the items in order to receive them when both items are in stock.
  • The product may not be refused by customers other than in cases of obvious damage or deficiencies in the product. Otherwise Skyshop will immediately dispatch the available items.
  • Skyshop will notify the customer that the order is ready for collection at Skyshop or that it has been dispatched.
  • Skyshop is not liable for consequential damages as a result of cancelled pre-orders or adapted pre-order quantities.
  • Skyshop is not responsible for items which, despite having been paid for, the factories have not fulfilled the quantities requested by Skyshop.

TIP: Each pre-order is charged a shipping fee. If you prefer and anticipate the dispatch of more than one pre-order, it is suggested that you use the Hold & Store option at checkout. (check the conditions). This will avoid various shipping costs. When the ordered items are available, shipping can be requested and a request for payment of the applicable shipping fee will be issued.

    Section 7e. Special Requests

 

Several products are not permanently stocked by Skyshop, but are available for special orders via the Skyshop website. Delivery times for these products are an indication that depends on the producer or distributor.


For special orders, the following applies:

  • Special orders are only accepted when accompanied by payment of the full amount of the special order.
  • Special orders for different products from various suppliers are considered and treated as separate orders.
  • Shipping costs apply to each special order and will be charged and paid before the special order can be processed (not applicable in the case of "pick-up special orders").
  • The customer will be notified when the special order is ready to be picked up at Skyshop or when a special order has been dispatched.
  • The delivery times mentioned on the Skyshop website are indicative and non-binding.
  • Skyshop is not liable for any compensation when actual delivery times differ considerably from those mentioned on the Skyshop website.
  • Skyshop is not liable for consequential damages as a result of cancelled or incomplete special orders.

  • Skyshop is not liable for consequential damages as a result of cancelled or incomplete special orders.

    Section 7f. Shipments/Distribution

 

Deliveries by CTT:

  • Skyshop uses CTT services for all deliveries.
  • Shipping and deliveries via CTT can be tracked via the CTT website.
  • Skyshop does not support alternative methods of transport other than CTT, unless the customer agrees or informs Skyshop of the possibility of being sent by another means.
  • Skyshop honours requests for alternative methods of transport, to the exclusion of all liability on the part of Skyshop in the event of damage, delay or loss of the shipment.

    Section 7g. Returned shipments

 

  • It is the customer's responsibility to make arrangements for the delivery of ordered goods to be accepted and signed for at the delivery address or pick-up point designated by the customer.
  • Undelivered orders are returned to Skyshop.
  • Skyshop will re-charge the shipping costs for items that have been returned for any reason (e.g. incorrect address, absent customer, unknown customer, etc.). In the case of countries outside the European Union, where export and import taxes apply, the customer will be responsible for paying them in the event of a return, unless the item is damaged.

    Section 7h. Pick-up service

 

The Skyshop website allows customers to choose to collect their ordered products from Skyshop. This option is offered for selection when checking out on the Skyshop website.


The pick-up service is offered under the following conditions:

  • Orders are only accepted if they are accompanied by payment of the total amount of the order.
  • Purchased products are stored at Skyshop.
  • The maximum storage period at Skyshop is limited to two months.
  • Skyshop reserves the right to offer backorders for sale without prior notice and without any obligation to the original customer, except to refund the amount paid by the customer.
  • The Customer is obliged to accept the reserved goods after two months of overdue storage of the remainder of the reserved goods.
  • Guarantee conditions and claims remain in force and begin on the date of withdrawal.
  • The Customer agrees and accepts the risk of replacement products not being available in the event of loss or imperfection at the time of collection. The guarantee shall be limited to reimbursement of the cost in such a case.

    Section 7i. Hold & Store Service

 

Skyshop's "Hold & Store" service is an exclusive service that allows Skyshop.store customers to benefit from reduced shipping costs when two or more orders are combined into a single consignment. Products offered via another Skyshop site are excluded from this service.


The shipping rate is always a combination of a fixed basic rate, depending on the recipient's country and area, and a variable increment depending on the volume or value of the total order. When you edit the shopping basket and select the destination country, it will show the applicable shipping rate. When two or more orders are combined, the increments remain in place, but the basic shipping rate is only charged once.


The Hold & Store service is offered under the following conditions:

  • The customer must select the Hold & Store option at the end of their order.
  • Hold & Store orders are only accepted when accompanied by payment of the full amount.
  • Hold & Store orders cannot be changed or cancelled once they have been processed.
  • Purchased products are stored at Skyshop.
  • Skyshop reserves the right to offer Hold & Store orders in arrears without prior notice and without any obligation towards the original customer, other than a refund of the amount paid by the customer.
  • Warranty conditions and claims remain in force and begin on the date of delivery.
  • Delivery via courier services is excluded from this service.
  • Returns or cancellations are not accepted.

    Section 7j. Warranty and Claims

 

  • Products purchased through the Skyshop website are free from defects unless otherwise stated or assumed.
  • Complaints must be reported to Skyshop immediately and within 48 hours of delivery or collection.
  • The legal guarantee for products purchased by citizens of the European Union is 2 years after purchase (applies to products that are not guaranteed by the guarantee; does not apply to models and clothing).
  • The guarantee for goods purchased by non-EU citizens is in accordance with the applicable guarantees of their respective manufacturers, distributors and suppliers, if any.
  • The warranty after 2 years always expires when it can no longer be entrusted to the respective manufacturer, distributor or suppliers affected by bankruptcy or cessation of production.
  • Eligible warranty claims on Skyshop or its suppliers imply free repair or replacement. The warranty is limited to the repair or replacement of the defective part or product and emphatically excludes any reimbursement of the shipping fee and import duties.
  • Without limiting the generality of the foregoing, Skyshop expressly disclaims all liability for product defect or failure, claims due to normal use, misuse, abuse, service or modification of the product other than Skyshop-approved maintenance, improper product selection, non-compliance with any code or misappropriation.
  • Skyshop is not liable for consequential damages or inconvenience.
  • The Customer is aware that replacement of defective products may not be available.

    Section 7l. Cookies

 

A cookie is a small computer file or piece of information that can be stored on the hard drive of the customer's computer when the customer visits websites. The Skyshop website employs the use of cookies to improve the functionality of the websites and, in some cases, provide visitors with a personalised online experience. Cookies are widely used and most web browsers are initially configured to accept cookies automatically. Visitors can change their web browser settings to prevent their computer from accepting cookies. Disabling cookies, however, will prevent visitors from getting the best performance from the Skyshop website. By using the Skyshop website, visitors accept the use of cookies in accordance with Skyshop's privacy policy.

    Section 7m. Customer account

 

Customers using any Skyshop service are responsible for maintaining the confidentiality of their account and password and restricting access to their computer and agree to accept responsibility for all activities that occur under their account or password. Skyshop sells products for children, but sells them to adults who can buy products with a credit card or other permitted payment method. If customers are of legal age in their country or region, they may use Skyshop's services only with the involvement of a family member or guardian. Skyshop reserves the right to refuse service, terminate accounts, remove or edit content, or cancel orders at its sole discretion.

Section 8 Product waivers

    Section 8a General

 

The laws of certain jurisdictions do not allow limitations on implied warranties or conditions or the exclusion or limitation of certain damages. If these laws apply to the customer, some or all of the following disclaimers, exclusions or limitations may not apply and the customer may have additional rights.

To the fullest extent permitted by applicable law, the Company disclaims all warranties and conditions, express or implied, including, but not limited to, implied warranties of title, merchantable quality and fitness for a particular purpose. The Company does not warrant that the Company's services, information, content, materials, products (including software) or other services included or made available to the customer through the Company's services, its servers, electronic communications or e-mails sent by Skyshop will be free of viruses or other harmful components. The Company shall not be liable for any damages of any kind arising from the use of any company's services or from any information, content, materials, products (including software) or services included in or otherwise made available to the customer through any of the Company's services, including, but not limited to, direct, indirect, incidental, punitive and consequential damages, unless otherwise stated in writing.

 

    Section 8b. Renunciation of Collector's Models

 

Most display models are handmade. Although quality is guaranteed, it should be borne in mind that small imperfections will always be part of their nature. Display models can be subjected to extensive examination at Skyshop. Customers, who order these models via the Skyshop website, accept the presence of minor imperfections (*) and will not be eligible for a refund.

Section 9 Privacy Policy

 

The Company stores names, telephone numbers and e-mail addresses of customers for administrative and commercial purposes. They are used exclusively by Skyshop and will not be provided to third parties under any circumstances.


The Company is committed to maintaining the accuracy, confidentiality and security of customer personally identifiable information ("Personal Information"). As part of this commitment, this privacy policy governs the Company's actions regarding the compilation, use and disclosure of Personal Information.

  • Introduction: The Company is responsible for maintaining and protecting the Personal Information under its control.
  • Identifying Purposes: The Company collects, uses and discloses personal information to provide the customer with the product or service that has been requested and to offer additional products and services that the Company believes the customer may be interested in. The purposes for which the Company collects Personal Information will be identified before or at the time the Company collects the information. In certain circumstances, the purposes for which information is collected may be clear and consent may be implied, such as where the customer's name, address and payment information is provided as part of the order process.
  • Consent: knowledge and consent are required for the collection, use or disclosure of Personal Information, except as required or permitted by law. Providing the Company with Personal Information is always the customer's choice. However, the customer's decision not to provide certain information may limit the ability to provide the customer with the Company's products or services.
